§ 115.02. SALES.

- (A) It shall be unlawful for any person to conduct a yard sale within the city without first filing with the City Clerk the information hereinafter specified and obtaining from the city a permit to do so, to be known as a Yard Sale Permit to be issued without charge.(B) Such permit shall be issued to any one location no more than one (1) time per month not exceeding three (3) consecutive days from Thursday to Sunday. Each permit issued under this section must be prominently displayed on the premises upon which the yard sale is conducted through the entire period of the permitted sale.(C) The information to be filed with the City Clerk pursuant to this section shall be:(1) Name of person, firm, group, corporation, association or organization conducting the yard sale.(2) Name of owner of the property on which said yard sale is to be conducted, and consent of owner, if applicant is not the owner.(3) Street address at which yard sale is to be conducted.(4) Number of days of sale.(5) Date of any prior yard sales within preceding twelve (12) calendar months at the requested address.(D) The provisions of this section shall not apply to or affect the following persons or sales:(1) Persons selling goods pursuant to an order or process of a court of competent jurisdiction.(2) Persons acting in accordance with their powers and duties as public officials.(3) Any person selling, advertising, or advertising for sale, no more than five (5) items of personal property which are specifically named and/or described in the advertisement.(E) Any item(s) which are not sold on the date of sale specified in the permit required by this chapter, shall be removed from the sale location immediately after dusk on the sale date.(Ord. 2005-06, passed 5-16-05; Am.
